Conduct: Richard Michael Chamberlain (“Mr Chamberlain”) failed to comply with their statutory duties to ensure that caused Capital Chrome Limited (“Capital”) to trade to the detriment of HM Revenue and Customs (HMRC) from at least 07/05/2015 in respect of VAT and at least 19/04/2017 in respect of PAYE/NIC resulting in a liability of at least £227,124.71 (VAT £121,393.11, VAT Surcharges £17,348.30, PAYE £85,316.85 and PAYE interest £3,066.45), in that: VAT • HMRC’s records show that Capital submitted VAT returns for all trading quarters throughout the life of the company from 06/14 up to 12/17 which showed liabilities due totalling £138,741.41 inclusive of surcharges totalling £17,348.30. • Capital failed to make full payment of VAT for the quarter 03/15 which was due for payment in full by 07/05/2015. The return for the quarter totalled £14,789.07, surcharge totalled £739.45 and payments made totalled £5,419.33 giving rise to arrears of £10,109.19. • Payments made from 07/05/2015 to CVL were £81,273.06. • The last payment to HMRC in respect of VAT was £15,759.59 on 07/11/2017. This payment cleared the return for VAT quarter 09/17 in its entirety with the remainder allocated against historic VAT arrears. PAYE • HMRC’s claim in the Liquidation is £88,383.30 (2016/2017 £27,358.46, 2017/2018 £52,238.98 and 2018/2019 £5,719.41 plus combined interest of £3,066.45) • All PAYE returns were made up to and including April 2018. • PAYE liability for 16/17 was £85,196.76. Credits were made totalled £57,838.30 (including £3,000.00 for Employers Allowance) leaving £27,358.46 owing. • PAYE liability for 17/18 was £79,597.44. Credits were made totalled £26,899.54 (including £3,000.00 for Employers Allowance) leaving £52,238.98 owing. • PAYE liability for 18/19 was £7,605.19. A credit of £1,885.78 was made for Employers Allowance leaving £5,719.41 owing. • The last payment made to PAYE was £6,184.27 on 22/12/2017. Comparative Treatment • The position at the date of Liquidation on 16/05/2018 as per the Notice of Statement of Affairs was that HMRC was owed at least £245,000.00 and £18,929.08 was owed to Trade & Expense Creditors. • An analysis of bank statements in respect of 2 bank accounts show that from the allegation date (07/05/2015) to CVL (16/05/2018) for account 1 receipts total £1,406,880.07 and payments total £1,411,220.91. For account 2 receipts and payments total £197,505.86 all by way of internet transfers via account 1. • Within the allegation period transactions attributed to HMRC from account 1 are £272,092.82 Filed abbreviated accounts show for period ending 31/03/2015 creditors total £82,378.00 and for period ending 31/03/2016 £138,237.00
