Conduct: On 25 June 2020, Mahnoor Faisal (“Ms Faisal”) caused Green Orchid Limited (“Green Orchid”) to make a Bounce Back Loan (“BBL”) application of £48,000 when she knew or ought to have known that Green Orchid was not entitled to a loan of that amount. Ms Faisal made a wrongful declaration on the BBL application using an overstated turnover figure of £205,000. As a result, Green Orchid received more BBL funds than it was entitled to and did not use the entirety of the loan monies for the economic benefit of the Company in that: • The terms of the Bounce Back Loan Scheme (“BBL”) stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover.  • The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes. • Green Orchid was incorporated on 10 January 2014, commenced trading shortly thereafter and was therefore required to provide turnover for the calendar year 2019. • On 25 June 2020, Ms Faisal caused Green Orchid to apply to its bank for a BBL. The figure provided to Green Orchid’s bank on the BBL application as annual turnover for the 2019 calendar year was £205,000 and a BBL of £48,000 was requested. • Analysis of Green Orchid’s bank statements show that in the calendar year of 2019, total income into Green Orchid’s bank account was £35,215. • On 26 June 2020, Green Orchid received BBL funds of £48,000. The balance prior to receipt of the BBL was £489. • Between 27 June 2020 and 10 February 2021, and before further credits were received into the bank account, the BBL monies served to make payments totalling £29,000 to an associated company and cash withdrawals totalling £7,400. • Ms Faisal resigned as a director of Green Orchid on 01 May 2022. • The Statement of Affairs prepared in connection with the liquidation and signed by Ms Faisal’s successor director lists debts owed to creditors of £53,122 of which at least £48,120 was owed in respect of the BBL. Subsequently, the bank has submitted a claim in the liquidation proceedings in the sum of £49,322 in respect of the BBL.
