Conduct: On 07 January 2021, Sheila Dayah (‘Mrs Dayah’) caused Montessori (Baby Unit) Ltd (‘Montessori’) to apply for a Bounce Back Loan (“BBL”) using inaccurate turnover figures, which resulted in Montessori obtaining a BBL that was more than it was entitled to. Further the BBL funds were not used in their entirety for the benefit of Montessori in breach of the BBL terms and conditions. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 or estimated turnover if it had been established after 01 January 2019. Businesses were required to use the loan only to provide economic benefit to the business. • Montessori was incorporated on 07 January 2014. • Montessori filed dormant accounts in 2015, 2016, 2017, 2018 and in 2019. • Montessori’s only known bank account was opened on 29 October 2020. • On 07 January 2021 Montessori completed an application form for a BBL from its bank, self-certifying that its turnover for 2019 was £348,000 and requesting a loan of £50,000. • Mrs Dayah was a director of Montessori at the time the BBL application was made. • No evidence has been supplied to support that the company turnover in 2019 was £348,000. • On 08 January 2021, the BBL of £50,000 was paid into Montessori’s account. • On 11 January 2021, a transfer of £16,000 was made to an account in the personal name of Mrs Dayah. • No evidence has been provided that the funds were used for the economic benefit of Montessori. • At the liquidation date the full amount of the BBL remains outstanding.
