Conduct: On 18 May 2020, Anna Magdalena Szolc (Ms Szolc) caused Mrs Ladybird St.Albans Ltd (hereinafter referred to as “MLS”) to obtain a £50,000 Government Backed Covid-19 Bounce Back Loan (“BBL”), and failed to use it in its entirety for the economic benefit of MLS, in breach the Terms and Conditions of the Scheme, in that: Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of 25% of turnover. The purpose of the loan was to provide economic benefit to the business. MLS was incorporated and started trading on 05 December 2013. On 18 May 2020, Ms Szolc submitted an application to obtain a BBL of £50,000 on behalf of MLS. The BBL funds were credited into MLS’s bank account on 20 May 2020 and transferred on the same day to MLS’s savings account. On 20 July 2020, £63,200 were transferred from MLS’s savings account into MLS’s current account. On the same day, £65,000 were transferred from MLS’s current account to a connected company. As Director of the connected company, Ms Szolc had applied for it to be struck off the company’s register on 31 March 2020, 48 days before applying for the BBL via MLS. The connected company was dissolved on 06 October 2020 with no liabilities. No evidence has been provided to show the transfer of the BBL funds to the connected company was for the economic benefit of MLS. On 29 September 2022, MLS entered liquidation with liabilities totalling £80,254 of which £44,444 relates to the amount owed in respect of the BBL.
