Conduct: Kelly Ann Philpot (“Miss Philpot”) caused A.B.V Southeast Limited (“ABVSL”) to obtain a Bounce Back Loan (“BBL”) of £50,000 to which it was not entitled, as it was not trading on 01 March 2020, nor at the time of the BBL application on 26 October 2020, contrary to the terms and conditions of the BBL Scheme. BBL funds totalling £49,998 were paid to Miss Philpot or to her personal benefit and did not provide economic benefit to ABVSL, in breach of the BBL Scheme terms and conditions. • The BBL Scheme terms and conditions required the applicant to declare that the business was engaged in trading or commercial activity at the date of the BBL application; had been carrying on business on 01 March 2020 and had been adversely affected by coronavirus. Under the BBL scheme businesses were also required to use the loan solely for the economic benefit of the business; • Miss Philpot confirmed ABVSL ceased trading in November 2019; • ABVSL’s bank account statements show final trading income was received on 13 December 2019; • On 14 October 2020 ABVSL opened a bank account with a different bank; • On 26 October 2020 Miss Philpot applied for a BBL of £50,000 on behalf of ABVSL. On 29 October 2020 a BBL of £50,000 was credited to ABVSL’s bank account; • ABVSL was not trading on 01 March 2020 nor at the time of the BBL application on 26 October 2020, contrary to the terms and conditions of the BBL scheme. Therefore, was not entitled to the BBL funds; • ABVSL’s bank statements show that on 29 October 2020 a lump sum of £40,000 was transferred to Miss Philpot. Between 10 November 2020 and 08 January 2021 further payments totalling £9,998 were made to Miss Philpot or made for her personal benefit. contrary to the BBL scheme terms and conditions; • Total liabilities at liquidation amount to £2,184,315 of which £50,000 is in respect of the BBL.
