Conduct: Ian Mark Kitson (“Mr Kitson”) caused IMK Air Conditioning Limited (“IMK”) to trade to the detriment of HM Revenue and Customs (“HMRC”) in respect of VAT from 07 March 2015 until 31 January 2017 (when the company ceased trading) resulting in a debt of £40,690 and in respect of Corporation Tax from August 2015 until January 2017 resulting in a debt of £21,593. • A VAT liability was incurred for the period 07 March 2015 to 31 January 2017 of £68,366 (including surcharges). Late payments totalling £18,660 were made via a time to pay agreement leaving an outstanding Corporation Tax liability of £21,593. • During the same period, 07 March 2015 to 31 January 2017, the bank statements for IMK show payments to the net benefit of suppliers totalling £211,867, to the director totalling £117,895, Wages totalling £56,962, Cash withdrawals of £18,076 and to Sub Contractors of £17,534 as well as various other company expenditure totalling £62,224. • At liquidation, IMK had total liabilities of £70,853, of which £68,212 comprised the debt to HMRC and £2,641 to a trade creditor.
