Conduct: On 2 June 2020 Peter Michael Rhodes (“Mr Rhodes”) caused Chamois Dor Ltd (“CDL”) to provide inaccurate information concerning CDL’s turnover in its application for a Government-backed Bounce Back Loan (“BBL”). As a result, the Company obtained £50,000 from the BBL scheme to which it was not entitled. Mr Rhodes has further failed to provide evidence that the BBL was used in its entirety for the economic benefit of the Company, contrary to the terms and conditions of the scheme. In that: The BBL scheme permitted loans to businesses, established before 1 January 2019, of up to 25% of a business’ turnover in the calendar year 2019, to a maximum of £50,000 and a minimum of £2,000. CDL was incorporated on 22 October 2013. On 2 June 2020 Mr Rhodes applied on behalf of CDL for a BBL of £50,000 declaring that its turnover for the calendar year 2019 was £250,000. Accounts for the year ended 31 October 2019 show that CDL had no turnover and state “The principal activity of the company is that of a hotel booking service, however during the year the company was dormant”. The company also had no turnover in the previous 3 years’ accounts and Mr Rhodes has confirmed that no turnover was obtained from 1 November 2019 onwards. The minimum BBL permissible was £2,000 which would require a turnover of £8,000. The company did not turnover this amount in the calendar year 2019 and was therefore not eligible for a BBL of any amount. The BBL application on 2 June 2020, included the Company’s declaration, “I/We undertake to use the credit granted on the basis of this agreement only to provide economic benefit to my/our business, for example providing working capital, or investing in my/our business. I/We also confirm that the Bounce Bank Loan will be used wholly for business purposes and not personal purposes.” On 3 June 2020 CDL received the BBL funds totalling £50,000 of which £13,822 of which was used to clear the overdraft on the account. On 3 June 2020 £34,000 was transferred to Mr Rhodes, of which £17,500 was transferred back to CDL between 5 October 2020 and 29 December 2020, leaving a net total of £16,500 transferred to Mr Rhodes. No evidence has been supplied to support that the £16,500 was used for the economic benefit of the company. A least £47,061 of the BBL remained outstanding at liquidation
