Conduct: Mr David Elroy Walters Jnr (“Mr Walters”) caused 4PROPERTYUK Limited (“4PROPERTYUK”) to apply for a government backed Bounce Back Loan (“BBL”) of £50,000, when he knew or ought to have known that 4PROPERTYUK did not meet the eligibility criteria for a BBL of that amount and in breach of the BBL terms failed to utilise the funds for the economic benefit of the business, In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The terms stipulated that the funds were to be used for the economic benefit of the business. • Mr Walters applied for a £50,000 BBL on 03 September 2020 with a stated turnover of at least £200,000 for the calendar year 2019. • The company accountant has verified turnover for the period 01 January 2020 to 31 August 2019 totalling £29,840. • The company’s Bank account shows credits totalling £11,924 between 1 September 2019 and 31 December 2019 • Considering the turnover figure of £41,764 for the calendar year 2019, the maximum BBL entitlement was £10,441. • No evidence of a higher turnover in relation to 4PROPERTYUKhas been provided by Mr Walters. • On 05 September 2020, £50,000 BBL was credited to the company’s bank account. • The overstatement of turnover resulted in 4PROPERTYUK receiving £39,559 more than it was entitled to. • On 05 September 2020, £25,000 was transferred from the company bank account to non-company bank account A. • On 06 September 2020, £25,000 was transferred from the company bank account to non-company bank account B. • No records have been provided to show that these payments were used for the economic benefit of 4PROPERTYUK. • At the date of Winding Up Order on 22 July 2022, £49,954 remained outstanding in respect of the BBL.
