Conduct: On 28 May 2020 Mir Kamran Ali (“Mr Ali”) caused Prokept Limited (“Prokept”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000, using overstated turnover figures, when he knew or ought to have known that Prokept was not eligible for a loan of that amount. In addition, Mr Ali transferred £40,000 of the BBL funds to himself, which was not for the economic benefit of Prokept, contrary to the terms and conditions of the BBL scheme. • Under the BBL scheme a business was able to borrow up to 25% of its turnover in calendar year 2019, up to a maximum of £50,000 and, if the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. • To be eligible to apply for the BBL, a borrower had to declare the business was carrying on its business on 1 March 2020 and that the company was engaged in trading or commercial activity in the United Kingdom as at the date of this application. • When applying for a BBL a business had to confirm that the funds would only be used to provide an economic benefit to the business and not be used for personal benefit. • Prokept was incorporated on 14 August 2013 and commenced trading on this date. • Prokept’s Year End 31 August 2019 accounts show turnover of £63,715. • Prokept’s Year End 31 August 2020 accounts show turnover of £31,340. • On 28 May 2020 Mr Ali applied for a BBL of £50,000 on behalf of Prokept, stating in the loan application that Prokept’s relevant turnover was £224,367. • On 1 June 2020 BBL funds of £50,000 were credited to Prokept’s bank account. • On 15 July 2020, £40,000 was transferred to Mr Ali’s personal bank account. Mr Ali has failed to evidence that the BBL funds were used for the economic benefit of Prokept. • At the date of liquidation on 2 October 2024, Prokept’s total liabilities were £62,406 of which £33,615 is owed to the bank in respect of the BBL.
