Conduct: From at least 22 June 2016 to 30 September 2017 when it ceased trading, Mark William Robinson (“Mr Robinson”) caused Wessex Cabinet Works Limited (“Wessex”) to trade to the detriment of HM Revenue and Customs (‘HMRC’) resulting in VAT, PAYE and NIC liabilities owed to HMRC of at least £153,211 inclusive of charges and interest in that: PAYE/NIC • In the tax year ending 05 April 2017, Wessex incurred PAYE and NIC liabilities totalling £78,621 inclusive of interest, first overdue for payment for the month ending 5 May 2016, due for payment on 22 June 2016. Wessex made payments of £31,640 towards the liabilities leaving an outstanding amount owed to HMRC of £46,981 • In the tax year ending 05 April 2018, Wessex incurred PAYE and NIC liabilities totalling £26,072 inclusive of interest. Wessex made payments of £6,236 towards the liabilities leaving an outstanding amount owed to HMRC of £19,836 • As at 21 August 2019, the date of liquidation, the amount claimed by HMRC in respect of PAYE and NIC for all periods up to cessation of trading in September 2017 was £66,817. VAT • Wessex incurred VAT liabilities totalling £87,766 for monthly VAT periods ending October 2016 to September 2017, inclusive of surcharges, based on returns submitted to HMRC. Wessex made payments of £3,001 that were allocated towards these VAT liabilities leaving an outstanding liability of £84,765. • Wessex made additional payments towards its VAT liabilities during this period, which included payments towards VAT arrears from periods prior to October 2016. The last payment made by Wessex towards its VAT liabilities was £3,000 made on 5 December 2017. • As at 21 August 2019, the date of liquidation, the amount claimed by HMRC in respect of VAT for all periods up to the cessation of trading in September 2017 was £86,394 COMPARATIVE TREATMENT OF HMRC • According to available bank statements for the period from 7 August 2016 to 30 September 2017, Wessex received payments totalling £630,832 and its expenditure totalled £606,972. • During this period, of the £606,972 paid out of Wessex’s bank account, £475,406 was spent on company trade expenses and overheads, £33,450 was paid to him and £98,116 was paid to HMRC. • According to the last set of accounts prepared by the accountants for the year ended 31 December 2015, the company liabilities for 2015 consisted of: HMRC £48,488, Trade £44,792, Hire Purchase £7,866 and Other creditors £3,302. The total due to creditors in 2015 was £109,269. • Wessex’s estimated liabilities at Liquidation total £174,711, of which £21,500 is owed to trade & expense creditors and £153,211 is owed to HMRC in respect of PAYE/NIC, VAT, penalties and interest for the periods 7 September 2016 to 30 September 2017.
