Conduct: Mr Costel Adrian Niculcea (“Mr Niculcea”) caused NCA Carpentry Ltd (“NCA”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover in an application to obtain a BBL of £44,000. This resulted in the Company receiving £20,342 more than it was entitled to. In that: • The BBL application scheme entitled businesses established prior to 01 January 2019 to apply for a BBL in the sum of 25% of its turnover in the 2019 calendar year, up to a maximum of £50,000. When making an application, an applicant had to self-certify the business’ 2019 calendar year turnover. • NCA was incorporated on 18 July 2013 and commenced trading on the same date. From 06 December 2018, Mr Niculcea was the sole director of NCA. • On 13 July 2020, Mr Niculcea applied for and obtained a BBL of £44,000 and on the application, Mr Niculcea declared that NCA’s 2019 calendar year turnover was £185,000. • NCA’s bank statements for the period 2019 show income of £81,386. Based on this level of trading income, NCA was eligible for a BBL of £20,342 and therefore NCA obtained £23,658 more in BBL funds than it was entitled to. • NCA entered creditor’s voluntary liquidation on 23 January 2023, and the BBL lender has claimed £34,041.77 in the liquidation.
