Conduct: Joshua Kaganda (Mr Kaganda) caused JOSH ELECTRICAL SERVICES LTD (JES) to apply for a Bounce Back Loan (BBL) of £50,000 on 25 May 2020 using overstated turnover figures. Consequently, JES received more monies than it was entitled and did not use the funds for the economic benefit of the company, in that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 its estimated turnover. To be eligible to access the BBL scheme a business had to be engaged in trading activity on 01 March 2020 and at the date of the BBL application. JES was incorporated on 24 May 2013 and was required to provide its turnover figure for 2019. On 25 May 2020 Kaganda applied for a BBL of £50,000 on behalf of JES declaring that its estimated turnover was £225,000. Accounts show that JES’s turnover to 31 May 2019 was £19,816 and to 31 May 2020 was £16,605. On 6 May 2020, BBL funds of £50,000 were received into the company’s bank account. The company bank statements show that in the period 12 June 2020 to 25 June 2020, net funds totalling £46,000 were paid to a third party, which was not for the economic benefit of JES. On 31 January 2022 JES entered creditors’ voluntary liquidation with liabilities of £52,593 which included £50,000 which is owed in respect of the BBL.
