Conduct: On or around 17 August 2020 Yuri Bilyarov (“Mr Bilyarov”) breached the terms of the government backed Bounce Back Loan (“BBL”) Scheme by causing Jupiter 13 Limited (“Jupiter”) to overstate its turnover on its application for a BBL of £50,000 resulting in the company receiving a BBL that was more than it was entitled to. Mr Bilyarov also failed to ensure that the entirety of the BBL funds were used for the economic benefit of Jupiter. In that: Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. Jupiter was incorporated on 18 February 2013. The company’s annual accounts for the financial year end February 2019 and year end February 2020 show turnover of £0 and £20,030 respectively. On or around 17 August 2020, Mr Bilyarov stated on the company’s BBL application form an annual turnover of £200,698. Consequently, on 19 August 2020, Jupiter received £50,000 BBL funds into its bank account which based on the February 2020 annual account was £44,992.50 more than it was entitled to. Following receipt of the BBL funds, payments totalling £31,000 were made to Mr Bilyarov’s own account and payments totalling £19,450 were made to other third-party individuals. No explanation or documentary evidence has been provided to show that the entirety of the BBL funds were used for the economic benefit of Jupiter. At liquidation, the company had total liabilities of £51,001, of which £50,000 was owed in respect of the BBL.
