Conduct: Mr Harvinder Boughan (“Mr Boughan”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing Boughan Limited (“BL”) to overstate its turnover on its application for a BBL, resulting in the company receiving a Top-Up BBL of £29,500 when he knew, or ought to have known, BL was not eligible for a BBL Top-Up loan of that value, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.   • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started to trade. • BL was incorporated on 21 January 2013. • Mr Boughan declared on the company’s BBL application form an annual turnover of £8,189,700, and consequently on 11 May 2020 BL received an initial BBL of £20,400. • On 11 November 2020 Mr Boughan applied for a Top-Up BBL of £29,500, meaning when it was received on 12 November 2020, BL had received a total of £49,900 under the BBL scheme. • Annual accounts for financial year ending 31 January 2020 show the company achieved a turnover of £88,756. • BL has claimed 56.2% of the annual turnover achieved in FYE 31 January 2020. • This means the company falsely declared that they were applying for 25% or less of the company turnover in 2019 on the BBL Top-Up application form. • The overstatement of turnover meant that BL received £27,711 more than it was entitled to from the BBL scheme. • BL entered Creditor’s Voluntary Liquidation on 28 June 2023. • At liquidation, BL had liabilities totalling £113,124, of which £44,439.23 was owed to the bank in respect of the BBL.
