Conduct: Between 7 November 2013 and 7 November 2014 Abdul Wahab caused Bangla Foods Vegetables Limited (“Bangla”) to submit false returns to HMRC in respect of Value Added Tax by failing to disclose the import and sale of illegal cigarettes. HMRC considered the non-disclosure to be deliberate and concealed, and raised assessments of £53,641 (excluding interest) plus penalties of £52,301, of which £90,102 remained unpaid at the date of liquidation. 1. Between 20 July 2013 and 10 September 2014, UK Border Force inspected 30 out of 262 consignments of vegetables imported by Bangla, of these consignments 8 were found to contain illegal cigarettes; 2. As a result of the UK Border Forces finding, HMRC estimated that the company illegally imported 1,839,150 cigarettes with a street price of £321,850 resulting in a VAT output tax liability assessment of £53,641; 3. In additional to the tax liability HMRC issued a penalty of £52,301 on the basis that the company deliberately concealed the purchase and sale of the illegal cigarettes within the onward supply chain. 4. Subsequent VAT reclaims by Bangla reduced the outstanding liability to £90,102 as at the date of liquidation.
