Conduct: On 16 May 2020, Eseoghene Bobori aka Ese Bobori (“Mr Bobori”) caused Happy Flames Ltd (“Happy Flames”) to breach the conditions of the Bounce Back Loan (“BBL”) scheme by overstating the company’s annual turnover on the BBL application in order to obtain a loan of £50,000, when it was due, at most, £24,398. In that: a) The BBL scheme allowed businesses affected by the Coronavirus pandemic to apply for a BBL of between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019 or if established after 1 January 2019 its estimated annual turnover. b) Happy Flames was incorporated and commenced trading on 14 December 2012. c) On 16 May 2020 Mr Bobori applied for a BBL of £50,000 stating in the application that Happy Flames’ turnover was £320,000. d) On 20 May 2020 the £50,000 BBL was credited to Happy Flames’ bank account. e) Accounts prepared for the period 1 January 2019 to 31 December 2019 list Happy Flames turnover at £97,592. Happy Flames was therefore entitled to £24,398 under the BBL scheme. f) Mr Bobori overstated Happy Flames’ turnover in the BBL application form by up to £222,408, resulting in Happy Flames being granted a BBL that was £25,602 more than it was entitled to under the BBL scheme. g) Happy Flames’ bankers are listed as a creditor in the company’s liquidation for £50,969.93 in respect of the BBL.
