Conduct: Mr Jamshaid Nabi (“Mr Nabi”) caused Jean & J Ltd (“Jean & J”) to apply for a government-backed Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known, that Jean & J was not eligible for any loan under the terms of the BBL Scheme and the BBL was not used for the economic benefit of Jean & J, in that: under the BBL scheme an applicant was required to confirm that the business was engaged in trading or commercial activity in the UK at the date of the application and was carrying on business on 01 March 2020. Jean & J was incorporated at Companies House on 20 November 2012 and ceased trading in 2016 (when Mr Nabi no longer required it for a previous job). dormant accounts for the Years Ended 30 November 2017, 30 November 2018, 30 November 2019 and 30 November 2020 were approved and signed by Mr Nabi on 16 August 2018, 27 August 2019, 4 November 2020 and 6 October 2021 respectively. Mr Nabi subsequently decided to set up a takeaway business, utilising the Jean & J name for this purpose. Jean & J, under this takeaway business, started trading on 01 February 2021 with the first trading income received in to the company bank account on 12 February 2021. on 2 June 2020, Mr Nabi applied for a BBL of £50,000 on behalf of Jean & J declaring that its turnover for the calendar year 2019 was £200,000. on 11 June 2020, funds of £50,000 were credited to Jean & J’s bank account. Between 11 June 2020 and 01 February 2021, at least £39,621 of the BBL funds were not used for the economic benefit of the company at the date of the Liquidation on 24 June 2022, Jean & J’s total liabilities were £52,246, of which £50,000 was in respect of the BBL.
