Conduct: Abdul Momith (“Mr Momith”) breached his duties as a director of Elachi Dine Limited (“Elachi Dine”) by failing to ensure that it complied with its statutory obligations under The Immigration, Asylum & Nationality Act 2006, resulting in the employment of illegal workers. In that: • Home Office Immigration Enforcement (“HOIE”) officers attended the trading premises of Elachi Dine on 28 November 2019 and issued a Notification of Liability for a Civil Penalty of £10,000 in respect of the employment of one illegal worker identified in this first visit (no right to work). Payment of this penalty was due on or before 13 February 2020. • Elachi Dine made payments totalling £4,167 towards this penalty but at the date of liquidation, £5,833 remained outstanding. • HOIE officers attended the premises of Elachi Dine for a second time on 07 March 2020, and following this, HOIE issued a second Notification of Liability for a Civil Penalty in the sum of £80,000 in respect of the employment of the four illegal workers identified in this second visit (all, no right to work). Payment of which was due on or before 25 February 2021. • Elachi Dine has not made any payment towards this second penalty that was due to HOIE. • Mr Momith was the solely appointed director of Elachi Dine at the time of the breaches of the Immigration, Asylum and Nationality legislation.
