Conduct: Between 12 Februrary 2019 and 11 July 2021, Mr Rana Dhaia (“Mr Dhaia”) was in breach of his duties as sole director of Townsend Poultry Limited (“Townsend”) by entering into transactions for goods that he knew or ought to have known were stolen. In that: • Between the above dates, Mr Dhaia caused Townsend to purchase animal products, namely chicken thighs, via a third party (“Party 1”) when he knew or ought to have known that these purchases were not in the usual course of business • Evidence provided by North Wales Police shows that in the period above, there were 140 transactions totalling £259,290 paid to Party 1 • Text messages between 20 December 2019 and 05 January 2021 via WhatsApp between Mr Dhaia and Party 1 indicate that the arrangement is not legitimate • Further evidence provided shows that there were at least 83 deliveries to the Townsend processing site of chicken which arrived from the Party 1’s employer (“Party 2”), who had no record of any purchases or shipments to Townsend • Furthermore, the auditor for Party 2 has stated that Townsend was a blocked customer at the time of these transactions • Mr Dhaia knew or ought to have known that these poultry products were stolen and that by purchasing them, he was causing Townsend to be a vehicle for the transfer of stolen property. • This resulted in a breakdown in the food supply chain, a negative impact on the public’s faith in food safety standards, a substantial loss to Party 2, and ultimately led to the insolvency and subsequent liquidation of Townsend with a loss to creditors of £222,451. It also led to a criminal conviction and custodial sentence for Mr Dhaia. • Multiple checks by the Food Standards Agency found that there were several issues surrounding the preparation, storage and traceability of the produce at the Townsend processing site. This resulted in produce being deemed unsafe for consumption, and a recall of products that had already been sold on. • Townsend had been trading since 2011, and therefore its director should have been aware of these requirements and ensured their implementation.
