Conduct: Mr Vasiliu caused Interfix to trade to the detriment of HM Revenue and Customs (“HMRC”) as regards to Pay as You Earn (“PAYE”) and the Construction Industry Scheme (‘’CIS’’) from 22 September 2020 to 01 May 2024 and Value Added Tax (“VAT”) from 07 February 2022 to 01 May 2024, the date of Liquidation. In that: PAYE • On 22 September 2020, Interfix had an outstanding PAYE liability including CIS to HMRC of £567. • Between 22 September 2020 and 01 May 2024, the date of Liquidation, liabilities in respect of PAYE and CIS had risen to £258,196. • During the same period two payments were made of £821 on 21 February 2022, and £25,000 which was made on 25 August 2022, following which the outstanding liabilities were £152,704. • Total liabilities in respect of PAYE owed to HMRC, including added interest and charges post Liquidation, amount to £258,396. VAT • On 07 February 2022, following the offsetting of VAT credits from later periods, Interfix had an outstanding VAT liability to HMRC of £336. • Between 07 August 2023 and 01 May 2024, the date of Liquidation, assessments were raised by HMRC totalling £35,827 and a further £1,565 had accrued in interest and penalties. • The last payment made in respect of VAT liabilities was for £11,137, made on 22 February 2022. • Total liabilities in respect of VAT owed to HMRC at Liquidation, including added interest and charges post Liquidation, amount to £38,818. Differential Treatment • In the year end November 2020 accounts, outstanding liabilities to HMRC were £23,898 and trade creditors were £0 • At Liquidation, the Statement of Affairs show HMRC liabilities had risen to £332,972 compared to trade creditors totalling £480 • HMRC remains the largest creditor at Liquidation with total liabilities owed to HMRC including PAYE, CIS, VAT, Corporation Tax and other charges and interest is £332,972.
