Conduct: Kelly Best (“Miss Best”) caused Harlow MOT Centre Limited (“Harlow”) to breach the conditions of the Bounce Back Loan (“BBL”) Scheme by overstating the company’s turnover for the calendar year 2019 and obtaining a BBL of £34,000, when it would have been eligible for a loan of at most £7,163. Of the £34,000 Harlow received, £26,841 was paid out to the benefit of Miss Best and her associates contrary to the conditions for the use of a BBL. In that: • The BBL criteria allowed a business to borrow between £2,000 and up to 25% of the company turnover, with a maximum loan of £50,000 for the purpose of a business carried on or intended to be carried on by the applicant. • A business was eligible to apply for the loan if it was established and carrying on business before 1 March 2020. • Based on income into the company bank account the company would have been eligible for a BBL of at most £7,163. • On 11 May 2020, BBL funds of £34,000 were paid into Harlow’s bank account. • From 13 May 2020 to 2 June 2020 there were unexplained payments totalling £32,309 made from Harlow’s bank account, of which at least £26,841 were paid to the benefit of Miss Best and her associates and not for the economic benefit of the company. • At the date of the Liquidation on 14 September 2021, a total of £247,329 was owed to creditors, of which at least £60,834 is due to a bank, £20,110 is due to HM Revenue & Customs, £41,784 is due in respect of other finance, and £124,601 is due to trade creditors.
