Conduct: Barrington Burnett (“Mr Burnett”) breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing BAB Electrical Services Limited (“BAB”) to overstate its turnover on its application for a BBL resulting in the company receiving a BBL of £44,000 when he knew or ought to have known that BAB was only eligible for a loan to a maximum value of £10,487. In that:? • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.?? • BAB was incorporated on 27 June 2011. • The company’s BBL application form declared an actual annual turnover of £176,000 for 2019, and consequently on 01 November 2020 BAB received a £44,000 BBL. • Annual accounts for financial year ending 31 March 2019 show the company achieved a turnover of £41,947, which would result in a BBL of £10,487. • Annual accounts for financial year ending 31 March 2020 show the company achieved a turnover of £40,815, which would result in a BBL of £10,204. • Using the higher turnover figure from the 2019 accounts. BAB’s turnover has been overstated by £134,053 and meant that BAB received £33,513 more than it was entitled to from the BBL scheme. • The BBL of £44,000 was received into the company bank account on 01 November 2020 and Mr Burnett failed to use the BBL funds in its entirety for the economic benefit of BAB; a condition of the loan. • BAB entered Creditors Voluntary Liquidation on 07 December 2022. • At liquidation, BAB had liabilities totalling £44,942.08, of which £44,542.08 was owed to the bank in respect of the BBL.
