Conduct: James William Hunt (“Mr Hunt”) caused Propsol 2 Ltd (“Propsol”) to breach the terms and conditions of the Government-backed Bounce Back Loan (“BBL“) scheme by applying funds totalling at least £42,000, obtained under the scheme, other than for the economic benefit of the Company, in that: • Propsol was incorporated on 23 June 2011 and started trading on incorporation. • Mr Hunt was appointed as a director from 23 June 2011 to liquidation and was the only director appointed and in office from 25 March 2014 until liquidation. • On 5 May 2020 Mr Hunt applied for a BBL in the sum of £50,000. • The BBL monies of £50,000 were credited to Propsol’s bank account on 13 May 2020. • Prior to receipt of the BBL into Propsol’s bank account on 13 May 2020, the account held a credit balance of £361. Receipt of the BBL monies lifted this balance to £50,361. • The BBL application form and BBL agreement required the loan monies to be used solely for the economic benefit of the Company. • Between 13 May 2020 and 27 May 2020, during which period no further credits entered the Company Bank account, the BBL monies were expended fully. • On 14 May 2020 a payment of £30,000 was made to Mr Hunt with the reference “James Hunt DL”. Mr Hunt has stated that the payment relates to a loan to purchase a competitor but has provided no evidence of any such purchase nor that the payment was for the economic benefit of Propsol. • On 17 May 2020 a payment of £12,000 was made to a furniture store. Mr Hunt has not explained the need for a payment nor has he provided evidence that this purchase represented the Company’s economic benefit. • The Proof of Debt filed in the liquidation by the lender states that £46,686.07 is owed to them by the Company in respect of the BBL.
