Conduct: Mr Rakesh Kunar Lagah (“Mr Lagah”) caused Oceanic Bathrooms Limited (“Oceanic”) to trade to the detriment of HM Revenue & Customs (“HMRC”) in respect of VAT from at least 20 November 2019 to 01 November 2023, the date of liquidation, in that:- • 18 VAT returns were submitted in relation to Oceanic for the periods January 2019 to April 2023 which totalled £181,868. • Only 2 payments totalling £15,242 has been made in relation to this liability; a payment of £5,811 was paid on 04 March 2020 which would have paid the 01/19 VAT return, and a further payment of £9,431 was made on 25 July 2023 which would have paid most of the 04/19 VAT return. • The subsequent VAT returns submitted for the periods from 07/19 (due to be paid September 2019) to 04/23 totalled £166,478 and these remained unpaid. • The amount outstanding for VAT at liquidation is £173,007 and surcharges of £10,176. Detrimental treatment • At the date of liquidation, creditors totalled £328,615 of which £231,489 was owed to HMRC. • A bank analysis for the period 20 November 2019 (the date of the first statement held) to 01 November 2023 (liquidation) shows payments into the account totalled £1,832,351 and payments made from the account totalled £1,855,891. In the same period a total amount of £56,282 was paid to HMRC of which £15,242 related to VAT.
