In that: - The BBL criteria allowed a business to borrow between £2,000 and up to 25% of the company turnover (up to a maximum of a £50,000 loan). Fresh’s financial statements for the year ending 31 March 2020 shows a turnover of £29,609. Between 1 January 2019 and 31 December 2019, sales income into the company’s bank account totalled £19,652. Fresh was therefore eligible to borrow a maximum of £4,913. On 10 May 2020 Mr Khawaja applied for a BBL of £50,000 on behalf of the company, with the application stating that Fresh’s turnover for 2019 was £210,000. On 12 May 2020, funds of £50,000 were credited to Fresh’s bank account. At the date of Liquidation on 1 November 2021, a total of £57,211 was due to creditors, including the full amount of the BBL. CLEOTEC LTD Mr Khawaja caused Cleotec to overstate its turnover on its application for a BBL resulting in Cleotec receiving £26,174 more than it was entitled to. In that: - The BBL criteria allowed a business to borrow between £2,000 and up to 25% of the company turnover (up to a maximum of a £50,000 loan). Cleotec’s financial statements for the year ending 31 March 2020 shows a turnover of £48,944. Between 1 January 2019 and 31 December 2019, sales income into the company’s bank account totalled £95,304. Cleotec was therefore eligible to borrow a maximum of £23,826. On 1 July 2020 Mr Khawaja applied for a BBL of £50,000 on behalf of the company, with the application stating that Cleotec’s turnover for 2019 was £210,000. On 01 July 2020, funds of £50,000 were credited to Cleotec’s bank account. At the date of Liquidation on 11 November 2021, a total of £80,694 was due to creditors, including the full amount of the BBL.
