Conduct: a-Updated throughout life of case by DLT Examiner Create additional table 4 for subsequent amendments Hayrish Rasul Mohamad failed to ensure that Adams Express Limited complied with its statutory obligations to HM Revenue & Customs (“HMRC”) to submit accurate returns to HMRC in respect of Value-Added Tax between the VAT periods ended October 2012 to July 2015 inclusive, resulting in potential lost revenue to HMRC of £196,802 and penalties of £172,202, plus an assessed liability for Corporation Tax totalling £104,555 for the years ended 2012/2013 and 2013/2014, and caused Adams Express Limited to trade in illicit tobacco, in that: • During an inspection by HMRC dated 29 October 2014 a total of 62 packets of 20 illicit cigarettes and 5 50g pouches of illicit tobacco were seized from the shop operated by the company and an associated address; • During an inspection by HMRC the company was found to be operating two tills at the trading premises, sales from which were recorded in a cashbook maintained at the premises with entries dated between 19 July 2014 and 28 October 2014 but noted that takings from only one of the tills were reported to HMRC in the company’s 07/14 and 10/14 VAT returns. • HMRC concluded that the company had sold illicit tobacco products through the second till and that the undeclared income derived from such sales represented 46% of all sales made or a suppression rate of declared income of 86%. • HMRC raised best judgement assessments of £344,304 for VAT covering the entire trading period as supported by the history of seizures made throughout, of which £196,802 related to the period during which Mr Mohamad was in office. • HMRC’s final claim in the liquidation is £1,093,715 including interest, penalties and charges.
