Conduct: On 13 August 2020 Jean Griffin (“Mr Griffin ”) caused Gryphon Hospitality Limited (Gryphon) to make an application for a second Bounce BBL of £50,000, which Gryphon was not entitled to: • Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses. • Gryphon was incorporated on 26th April 2010. • Mr Griffin’s co director made an application to Bank A for a BBL of £50,000 on behalf of Gryphon on or around 14th July 2020 declaring that its turnover for the calendar year 2019 was £277,808. • The BBL funds were paid into Gryphon’s bank account on 14th July 2020. • Mr Griffin’s made a further BBL application to Bank B of £50,000 on behalf of Gryphon on the 13th August 2020, stating the turnover as £270,000. • Mr Griffin signed the declaration on the application form and BBL agreement on 13 the August 2020 confirming that Gryphon had not received any other BBL. • The funds from Gryphon’s second BBL were paid into its bank account on 14th August 2020. • Total liabilities at liquidation amounted to £89,263, of which £35,000 is in respect of the BBL obtained from Bank A and £41,000 on respect of amount of BBL obtained from Bank B.
