Conduct: On 22 June 2020 Shahbaz Ibrahim Khot (“Mr Khot”) caused Nabiha Ltd (“Nabiha”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in Nabiha obtaining a BBL that was more than it was entitled to. Mr Khot caused or allowed Nabiha to expend the £50,000 BBL funds for purposes that did not provide economic benefit to Nabiha, in breach of the BBL terms and conditions. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Nabiha was incorporated on 11 September 2009. • On 22 June 2020, Mr Khot applied for a BBL of £50,000 on behalf of Nabiha declaring that its turnover for the calendar year 2019 was £210,000. • Accounts dated 30 September 2019 show turnover of £54,645; these were signed on 14 June 2020. • Accounts dated 30 September 2020 show turnover of £35,550. • Nabiha received the BBL funds of £50,000 on 25 September 2020. • Between 05 November 2020 and 27 November 2020 £30,000 was transferred to Mr Khot and £20,000 was transferred to his co-director. Of this amount at least £30,775 came from BBL funds. • Total liabilities at liquidation amount to £42,785 of which £42,535 relates to the amount owed in respect of the BBL.
