Conduct: On 23 June 2020, Mrs Harvey (previously known as Denise Elba) provided false information in an application for a bounce back loan (“BBL”) of £50,000 that she made on behalf of ELBAD by overstating ELBAD’s annual turnover, with the consequence that ELBAD obtained a BBL that was greater than it was entitled to, in that: • Mrs Harvey was the sole director of ELBAD; • Under the BBL scheme, a business could apply for a loan of up to 25% of its turnover in the calendar year 2019, from a minimum of £2,000, up to a maximum of £50,000; • Professionally prepared accounts of ELBAD’s trading for the year ended 31 July 2019, which were signed by Mrs Harvey on 13 December 2019, show a turnover of £20,000; while ELBAD’s bank account showed receipts totalling £24,743 during the 2019 calendar year; • In an application for a BBL dated 23 June 2020, Mrs Harvey falsely stated that ELBAD’s annual turnover was £200,000; • In the period 26 June 2020 to 10 July 2020, payments totalling £49,815 from the BBL were made from ELBAD’s bank account; • Of the £49,815 Mrs Harvey has failed to provide satisfactory explanation supported by documentary evidence that £28,100 was expended for the economic benefit of ELBAD; • The BBL of £50,000 remained outstanding at liquidation on 09 September 2021.
