Conduct: From 07 December 2018 onwards, Sarah Allsopp (“Ms Allsopp”) caused LPM Plant Hire & Sales Ltd (“LPM”) to breach the terms of the finance agreements between the finance companies and LPM resulting in a loss to the finance companies at liquidation of £826,452 in that: LPM obtained funding from various finance companies from 07 December 2018 onwards in order to obtain assets. LPM allowed an associated company to act as an agent in the sale of the assets. Neither the associated company nor LPM had permission to sell the assets, per the terms of the outstanding finance agreements. The associated company subsequently retained the funds from the sale of the assets and failed to clear the outstanding finance due to the finance companies, or return said funds back to LPM in full. LPM failed to pay the finance when payment was due in accordance with the terms of the finance agreements. LPM failed to return the goods to the finance companies in accordance with the terms of the contracts. As a result, the finance companies have made claims in the liquidation for the total sum of £826,452 in respect of outstanding finance fees without being able to recover the assets nor monies owed.
