Conduct: Mohammed Shahab Uddin Ahmed (“Mr Ahmed”) caused Red Chilli Gold Restaurant Ltd (“Red Chilli”) to not comply with its statutory obligations under the Immigration, Asylum and Nationality Act 2006. In that: • Red Chilli was incorporated on 19 November 2008 and Mr Ahmed was appointed as the sole director from 12 January 2009 until Liquidation. • Red Chilli did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 resulting in the employment of two people who did not have the right to work in the UK. • Home Office Immigration Enforcement (‘HOIE’) officers attended at the Company’s trading premises on 20 June 2024 and identified two people suspected of being employed by the Company without a right to work in the United Kingdom. • Mr Ahmed has not provided any evidence to show that Red Chilli conducted “right to work” checks. • A Civil penalty notice was issued by HOIE in the sum of £80,000 with a requirement to pay £56,000 by 16 August 2024 in order to receive a reduction in the penalty. • Red Chilli has not paid the penalty due to HOIE. • Red Chilli went into liquidation on 18 November 2024 with the sum of £80,000 outstanding.
