Conduct: Mahbubur Rahman Chowdhury (“Mr Chowdhury”) caused Advocate Claims Ltd (“ACL”) to breach the terms and conditions of the bounce back loan (“BBL”) scheme by applying for two loans from different lenders, when any company was entitled to apply for only one, and by providing inaccurate statements of turnover on the application forms, in that: A company could apply for a single BBL of up to 25% of its turnover for either the 2019 calendar year or, if it started to trade on or after 01 January 2019, could estimate its turnover for the calendar year from the date when it started to trade. The 25% was subject to a minimum of £2,000 up to a maximum of £50,000. On 31 March 2020, Mr Chowdhury signed annual accounts to 30 June 2019 which recorded nil turnover for the year, and bank statements record nil income from 01 July 2019 to 01 June 2020. On 01 June 2020, Mr Chowdhury applied for a BBL with Bank 1. He requested a loan of £50,000 and self-certified that ACL had an annual turnover of £200,000. The company received £50,000 on 02 June 2020. On 03 July 2020, Mr Chowdhury applied for a second BBL with Bank 2. He requested a loan of £50,000 and self-certified that ACL had an annual turnover of £250,000. The company received £50,000 on 08 July 2020. ACL entered Creditors Voluntary Liquidation on 20 December 2022. At liquidation, ACL had liabilities of £107,800 of which £97,475 is owed for the outstanding BBLs.
