Conduct: Between 28 February 2019 and 07 April 2022, Palbinder Singh Sunner (‘Mr Sunner’) caused International Exotics Limited (‘IEL’) to submit Value Added Tax (“VAT”) returns to reclaim at least £780,000, which he knew to be false and that the sales and purchases declared in those returns were substantially different to the transactions recorded on IEL’s bank account over the same period. In that: • IEL was incorporated on 19 December 2003 and operated as a wholesaler for fruit and vegetables. • Between 28 February 2019 and 07 April 2022, fictitious debits and credits were entered onto IEL’s records for Company A (“CA”) totalling £4,680,000. These payments did not exist and were not included as transactions on IEL’s bank statements. • Between 16 April 2019 and 07 April 2022, fictitious debits and credits were entered onto IEL’s records for Company B (“CB”) totalling £4,680,000. These payments did not exist and were not included as transactions on IEL’s bank statements. • From quarter 02/19 to 04/19, IEL began making large VAT reclamations based on the input tax from these fictitious entries. Comparison of these VAT Returns to the transactions recorded on IEL's bank statements over the same periods indicates a material difference between the income and expenditure of IEL to that declared to HMRC. • As a result at least £780,000 was received by IEL from HMRC that IEL was not entitled to. • IEL entered CVL on 22 July 2022 with an overall company liability of £1,906,214.
