Conduct: On 27 May 2020, Lynda Carter (“Ms Carter”) caused All Sign Solutions Ltd (“ASSL”) to breach the conditions of the Bounce Back Loan ("BBL") facility by applying for a second BBL of £20,000 when she knew or ought to have known that ASSL was not entitled to the loan having previously applied for and received a BBL of £14,000 on 19 May 2020. Ms Carter caused ASSL to expend £33,000 of BBL funds received for purposes that did not provide economic benefit to ASSL, in breach of the BBL terms and conditions. In that: ? ? • Under the BBL scheme businesses were able to apply for up to 25% of their calendar year 2019 turnover, to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses and the BBL was to be used to provide an economic benefit to the business and not personal purposes.?? • Bank statements for calendar year 2019 show total receipts of £76,259, meaning ASSL was eligible for a BBL of no more than £19,064. ? • Ms Carter made an application for a BBL of £14,000 on behalf of ASSL on 19 May 2020 with Bank A, declaring turnover for calendar year 2019 of £56,000. Ms Carter requested in the BBL application form that the BBL funds be paid into her personal bank account.??? ? • Ms Carter made a further BBL application for £20,000 on behalf of ASSL on 27 May 2020 with Bank B, declaring turnover for calendar year 2019 of £81,000.?? ? • Ms Carter signed the declaration on the application form and BBL agreement on 27 May 2020 confirming that ASSL was not in the process of applying for or had not received any other BBL.? ? • The funds from ASSL’s second BBL were paid into its bank account on 08 June 2020.?On the same day, £19,000 was transferred to Ms Carter. ? • Total liabilities at liquidation amount to £83,502 of which £34,000 relates to amounts owed in respect of the 2 BBLs.??
