Conduct: Siva Anand Nair (“Mr Nair”) breached the terms of the government backed Bounce Back Loan (“BBL”) scheme by causing Crestgold Consulting Limited (“CCL”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £50,000 when he knew, or ought to have known, that CCL was not eligible for a loan of that value, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.   • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started to trade. • CCL was incorporated on 27 August 2002. • Mr Nair declared on the company’s BBL application form an estimated annual turnover of £200,000, and consequently on 16 May 2020 CCL received a £50,000 BBL, the maximum available under the BBL scheme. • Annual accounts for FYE 31 December 2019 show the company declared a turnover of £0. • Corporation Tax returns submitted to HMRC show the company declared a turnover of £0. • This would have meant that CCL would have not been eligible to apply for a BBL as the 2019 turnover did not meet the minimum amount required to apply for the minimum BBL of £2,000. • The overstatement of turnover meant that CCL received £50,000 more than it was entitled to from the BBL scheme. • CCL entered Creditor’s Voluntary Liquidation on 02 September 2024. • At liquidation, CCL had liabilities totalling £92,172, of which £43,811.95 was owed to the bank in respect of the BBL.
