Conduct: Jeremy Shaen Kyle-Milward failed to ensure that KM Skip Hire Limited (“Skip”) used the Coronavirus Business Interruption Loan (“CBIL”) which it received on 13 October 2023 to repay Skip’s existing Bounce Back Loan (“BBL”), which was a condition of the CBIL scheme. In that; • On 02 June 2020 Skip received a BBL of £50,000; • On 13 October 2020 Skip made an application for a CBIL of £148,000 and declared in the CBIL application form that it either did not have a BBL or would use the CBIL to repay the whole of any existing BBL; • It was a condition of the CBIL scheme that the money advanced must be used for the specified purpose and in the CBIL agreement it is recorded that the purpose was to provide working capital to support the borrower’s business or to fund expansion/growth of the borrower’s business; • The CBIL loan was paid into Skip’s bank account on 13 October 2020 but was not used to repay the whole of the BBL; • A total of 14 BBL loan repayments were made but Skip went into liquidation on 05 September 2023 with £41,677 still owed to the BBL lender.
