Conduct: From 31 August 2021 to 28 February 2024 being the date of liquidation, Vincenzo Colarusso (“Mr Colarusso”) caused Neath Hill Autos Ltd (“Neath”) to trade to the detriment of His Majesty’s Revenue & Customs (“HMRC”) in respect of Value Added Tax (“VAT”), Paye as You Earn Tax (“PAYE”) and Corporation Tax (“CT”), resulting in liabilities to HMRC increasing during the period by £327,859.33, inclusive of surcharges and penalties, in that: VAT • From 31 August 2021 until liquidation Neath made no payments to HMRC in respect of VAT. • Neath submitted VAT returns for the periods from August 2021 to August 2022 inclusive. The first of these was due for payment on 07 October 2021. • The total of these VAT returns is £106,751.37. • Neath failed to meet its statutory obligations to file VAT returns for all VAT periods from November 2022 onwards. • From November 2022 until liquidation, as no VAT returns were submitted for Neath, HMRC completed assessments for each period. These assessments total £54,621.78 • As no payments were received, penalties, surcharges and interest in respect of VAT totalling £25,607.43 were added. • During the period Neath incurred a total liability for VAT of £186,980.58 PAYE • From 31 August 2021 until Liquidation, Neath submitted monthly Real Time Information (“RTI”) returns in respect of PAYE. • Between 05 September 2021 and 05 March 2024, these returns total £103,563.95. The first of these returns was due for payment on 22 September 2021. • Against these returns, Neath made payments totalling £18,421.00 and there were Employment Allowance deductions applied totalling £14,000.00. • As not all payments were received in respect of PAYE, penalties and interest totalling £1,058.53 were added. • During the period Neath incurred a total liability for PAYE of £72,201.48 CT • Neath submitted a self-assessment return in respect of CT for the year ending 30 September 2021 showing that £56,231.07 was due in respect of CT. • As payment for this amount was not made, penalties totalling £11,446.20 were added. The sum of £67,677.27 falling due 1 June 2022. • A penalty of £1,000 was added for the year ending 30 September 2022 as no return was submitted by Neath in respect of this period prior to entering Liquidation. • During the period Neath incurred a total liability for CT of £68,677.27 • No payments in respect of CT were made during this time. Comparative Treatment • As per Neath’s accounts for the year ending 30 September 2021, HMRC debt accounted for £288,697 from total creditors of £840,935. At Liquidation, this had changed to HMRC debt being £565,925.15 from total creditor claims of £590,056.81 • Analysis of Neath’s bank account for the period 31 August 2021 to Liquidation, shows that of debits totalling £2,758,310.48, payments to HMRC totalled £20,752.92. • During that same timeframe, payments totalling £1,004,788.46 were made to “business advisers” who were trying to seek rates relief for the company, £211,781.34 was paid in wages/salary/pension payments and £119,099.75 was paid to Courts and Legal institutions, among other payments. • Mr Colarusso received payments totalling £17,705 from the company between 31 August 2021 and Liquidation. At Liquidation, HMRC submitted a claim for £565,925.15 out of creditor claims totalling £590,056.81.
