Conduct: Mr Cox failed to ensure that Birch Brothers (Kidderminster) Limited complied with statutory health and safety requirements in that to ensure that work at a construction site was organised in such a way that, so far as was reasonably practicable, pedestrians and vehicles could move without risks to health or safety, thereby breaching Regulation 27(1) of the Construction (Design and Management) Regulations 2015 and committing an offence contrary to section 33(1)(c) of the Health and Safety at Work etc Act 1974. • On 5 September 2017 a worker at a construction site at which the company was principal contractor suffered fatal injuries after being crushed by a vehicle. • An investigation by the Health and Safety Executive (“HSE”) found that the company had failed to adequately identify all hazards posed to pedestrians and to put in place adequate control measures, that the company had failed to organise the work in such a way as to ensure that vehicles and pedestrians were segregated in the work area, and that consequently workers were exposed to risk of death or serious injury. • The company pleaded guilty to breaching health and safety regulations and on 19 January 2023 the Court fined the company £146,000.
