Conduct: On 11 June 2020, Terence Giles Charlton (“Mr Charlton”) caused Charlton Recycled Autoparts Limited (“CRA”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) by applying for a second BBL of £50,000, which he knew or ought to have known that was not permitted under the terms and conditions of the BBL scheme as CRA had already applied for and received a BBL from another lender, in that: • Under the BBL scheme, businesses could apply for one BBL of up to 25% of their 2019 turnover, from a minimum of £2,000 to a maximum of £50,000. • RCA was incorporated on 3 February 1971. • On 04 May 2020, Mr Charlton made a BBL application on behalf of CRA with Bank A for a BBL of £50,000. The BBL funds were paid into CRA’s bank account on 05 May 2020. • On 11 June 2020, Mr Charlton made a further BBL application with Bank B for a BBL of £50,000 on behalf of CRA. The BBL funds were paid into CRA’s bank account on 12 June 2020. • The BBL application forms for both banks required the applicant to self-declare that they had not made any other application or already obtained a BBL for the business. Mr Charlton falsely declared on the second BBL application that CRA had not previously applied for or received a BBL with another lender. • CRA entered Voluntary Liquidation on 29 April 2025 with liabilities of £719,016. At liquidation £44,198 remained outstanding in respect of the two BBLs.
