HM LAND REGISTRY PROCEDURE FOLLOWING THE MAKING OF A BANKRUPTCY ORDER

The following is an outline of the procedure on the making of a bankruptcy order.

LCD = Land Charges Department

LR = Land Registry

N.B. LCD - procedure followed on the presentation of a petition

The court notifies the LCD of the presentation of a petition and the above flowchart is followed until it splits into jointly owned property and solely owned property. Reference to the ‘register of writs and orders’ should be read as the ‘register of pending actions’ and ‘bankruptcy restriction’ should be read as ‘bankruptcy notice’ (see paragraphs 50.18 and 50.19). No bankruptcy notice is registered against jointly owned property (see paragraph 50.20).
