Conduct: Jacqueline Lynda Brown (“Ms Brown”) caused Brown Solutions Limited (“the company”) to submit inaccurate returns to HM Revenue and Customs (“HMRC”) in respect of Value Added Tax (“VAT”) for the periods ending 03/23 to 09/23, resulting in HMRC assessing VAT totalling £10,475,676 was unpaid. In that: • The company registered for VAT on 1 June 2022 stating an estimated turnover of £100,000. • The company submitted VAT returns as follows: • Period 03/23 submitted on 31/07/2023 • Period 06/23 submitted on 31/07/2023 • Period 09/23 submitted on 07/11/2023 • HMRC conducted an investigation into the company and on 15 January 2024 wrote to the company advising that as they had failed to cooperate with their enquiries and they had been deregistered for VAT. • On 17 January 2024 HMRC wrote to the company advising they had failed to provide evidence to support the Input Tax claims. • As a result, on 17 January 2024, HMRC raised assessments of VAT under Section 73 of the VAT Act 1994 in the sum of £10,475,676. • Ms Brown was the sole director of the company from incorporation. • On 31 January 2024 Ms Brown placed the company into voluntary liquidation, leaving £10,475,676 outstanding.
