Conduct: John McGarvey (“Mr McGarvey”) caused CKO Civil Engineering and Surveying Limited (“the company”) to apply for, and receive, two Bounce Back Loans (BBL’s) of £50,000 each on 20 July 2020 and 25 August 2020 when the company (a) was not entitled to make two applications and (b) did not meet the criteria for the BBL scheme following which Mr McGarvey used £100,000 of the loan monies for his personal benefit, rather than for the economic benefit of the business in that: Prior to 10 November 2020 a business could apply for one BBL of between £2,000 and £50,000 subject to a maximum of 25% of turnover in the calendar year 2019. The accounts of the company for the period 08 October 2019 to 31 October 2020 declared the company achieved turnover of £46,428. On 20 July 2020 Mr McGarvey, on behalf of the company, submitted a BBL application to Bank 1 declaring the company had achieved, to date, a turnover of £225,000 resulting in the company obtaining a BBL of £50,000. On 25 August 2020 Mr McGarvey, on behalf of the company, submitted a BBL application to Bank 2 declaring the company had estimated turnover of £218,000 and no other application for a BBL had been made by the company resulting in the company obtaining a further BBL of £50,000. Within each BBL application Mr McGarvey declared that the BBL’s would be used to provide economic benefit to the business and would not be used for personal purposes. Notwithstanding the declaration made Mr McGarvey used the full £100,000 for personal benefit. On 11 November 2021 Mr McGarvey placed the company into Creditors Voluntary Liquidation with liabilities of £182,905 of which £100,000 is owed to the banks in respect of the BBLs. The balance of £82,905 is owed to HM Revenue & Customs.
