Conduct: On 25 November 2020 Christopher Thomas Burke (“Mr Burke”) caused TheCDC Limited (“CDC”) to apply for a Bounce Back Loan (BBL) of £50,000 using overstated turnover figures in the application form and as a result CDC has received BBL funds that it was not entitled to, in that: • A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover in calendar year 2019 or where a business was established after 1 January 2019, it is their estimated turnover. • CDC was incorporated on 8 August 2019. • Mr Burke applied for and obtained a BBL of £50,000 on 27 November 2020 and stated the annual turnover for CDC was £220,000. • On 27 November 2020 the BBL funds of £50,000 were deposited into the company bank account held with the lender of CDC. • The company accounts Year Ended 31 August 2020 disclose a turnover figure for the period of £28,327. • The company bank account was opened on 01/07/2019, and the bank statements show that from this date to 31/08/2020, trade/sales activity was approximately £38,282.22. From 01/07/2019 to 27/11/2020, being the date Mr Burke applied for the BBL, trade/sales activity was £40,447.22 across CDC’s bank Accounts. • The bank statements also show for the following 12-month period from 27 November 2020, being the date after the BBL funds were deposited into the company bank account, to 27 November 2021 trade/sales were £82,011.16. • Mr Burke has provided no clear evidence of how the turnover figure of £220,000 was determined. • On 10 May 2023, CDC entered Creditors Voluntary Liquidation with known liabilities of £52,082, of which £49,964 is owed in respect of the BBL.
