Conduct: Andrew Stevenson (“Mr Stevenson”) caused or allowed Derby Lane Ltd (“Derby Lane”) to obtain a Bounce Back Loan (“BBL”) of £50,000 to which he knew, or ought to have known, Derby Lane was not fully entitled. Consequently, Derby Lane received more monies than it was entitled to receive from the BBL scheme, in that: • A business could apply for a BBL of between £2,000 and £50,000, subject to a maximum of up to 25% annual turnover in the calendar year 2019. Where a business was established after 01 January 2019, BBL application instructed applicants to ‘apply the 25% limit to your estimated annual turnover from the date they started their business’. • Derby Lane was incorporated on 30 July 2019. • On 15 May 2020, Mr Stevenson’s co-director, on behalf of Derby Lane, completed and submitted a BBL application. In that application, Derby Lane’s estimated turnover from 30 July 2019 to 30 July 2020 was stated as £1,300,000. Derby Lane subsequently received £50,000 of BBL monies on 18 May 2020. • Mr Stevenson stated that he consulted on and ‘worked through the process’ of the BBL application with his co-director. • Analysis of Derby Lane’s company bank accounts demonstrates that between 30 July 2019 and 15 May 2020, Derby Lane achieved turnover of £32,500. • Mr Stevenson was unable to provide sufficient evidence to support that expectation. • Derby Lane made two repayments towards the BBL totalling £995. • On 12 July 2023, Mr Rodden placed Derby Lane into Creditors’ Voluntary Liquidation with total deficiencies of £128,000. £50,241 was outstanding in respect of BBL
