Conduct: Between 09 January 2023 and 19 January 2024, Russell Fleming (“Mr Fleming”) misappropriated at least £15,452 from R & R Lets (Scotland) Ltd’s (“R&R”) company client account and on 19 January 2024 transferred £20,000 from the company account to himself when he knew the company was going to be wound up, to the detriment of the company’s creditors: • 71 claims totalling £135,520.45 were received by the IP from landlords for missing rent. • Analysis of the rental account shows that Mr Fleming did not pass on rental payments received from tenants of at least £17,388 to the landlords of those properties. • Of the £17,388, £15,452 was diverted to Mr Fleming’s personal bank account in 21 transactions disguised with either the landlords’ or tenants’ names. • On 19 January 2024, after the petition had been made to wind up R&R, Mr Fleming debited £20,000 from R&R’s client account, transferring it to an account in his own name. • On 8 February 2024 R&R entered liquidation • At liquidation the company had liabilities of £182,109
