Conduct: On 19 May 2020 Mr Peter Donald Ferguson (“Mr Ferguson”) caused Beautiful Digital Events Limited (“BDEL”) to apply for a Bounce Back Loan (“BBL”) of £50,000 and used the funds for his personal benefit when he knew or ought to have known that BDEL failed to be eligible for the loan in that: 1. In order to be eligible for a BBL, both the Government and Starling Bank guidance stated that a company had to be established and operating before 1 March 2020 in order to meet the application criteria. BDEL was incorporated 25 November 2015 however Dormant Accounts were filed for the years ended 30 November 2019 and 30 November 2020 and therefore BDEL was not eligible to apply. 2. On the 19 May 2020 Mr Ferguson made an application for a BBL in the sum of £50,000 and made a declaration that BDEL met the eligibility criteria for the loan. 3. Within the application a turnover of £210,000 was used. On 28 August 2020 Mr Ferguson filed Dormant Accounts at Company’s House for the period ended 30 November 2019. On 11 February 2021 Mr Ferguson filed Dormant Accounts at Company’s House for the period ended 30 November 2020. 4. On 22 May 2020 £50,000 was paid into the company bank account. 5. On 11 July 2020 Mr Ferguson used £6,499 to purchase a motor vehicle for his private use. 6. On 25 August 2020 Mr Ferguson purchased a further vehicle for a cost of £12,600. 7. Between 30 September 2020 and 18 May 2021 Mr Ferguson withdrew additional £13,515 in salary, dividends and bank transfers. 8. BDEL failed to be eligible for the Bounce Bank Loan Scheme as it was not trading at the date of the application and the loan was used for personal purposes and not to provide economic benefit to the business 9. At liquidation the BBL of £50,000 remained outstanding and has not been repaid
