Conduct: 1. Mr Doherty failed to ensure that the Company maintained, preserved and/or delivered up adequate accounting records to explain the financial position of the Company to the Liquidators for the period from 1 March 2021 to 28 February 2023. As a consequence, it has not been possible to establish whether the Company was a genuine trading entity or a vehicle used for fraudulent purposes. In the absence of accounting records and any cooperation from Mr Doherty, the Liquidators and the Petitioner have been unable to verify the following: • Where the Company traded from, the nature of its business, its trading history and the day to-day roles and responsibilities performed by the Company’s directors; • What happened to the Company’s fixed assets which in the Company’s accounts to 28 February 2021 (signed by Mr Doherty on 28 November 2021) had a value of £187,009; • Whether (between 1 March 2021 and 28 February 2023), the credits received into the Company’s bank account totalling £1,838,767.43 and the payments totalling £1,962,005.84, of which £1,155,003 was paid to a company connected to the Company, were genuine transactions; • Why, on the instruction of a party connected to the Company, five creditors’ claims totalling £599,301.25 were submitted in the liquidation of the Company, seeking the Liquidators to convene a creditors meeting or a decision procedure to be held, when there is no evidence of the Company having a business relationship with those creditors; • The level of tax liabilities owed to His Majesty’s Revenue and Customs in respect of PAYE, VAT and CT; • Whether the Company met the relevant criteria to qualify for a Coronavirus Business Support Bounce Back Loan and if the £50,000 received under that loan was used for the economic benefit of the Company; and • Why the Company’s bank account was fraudulently used to receive Covid-19 support grants from three different local councils, totalling £106,425.
