He was an appointed director between 4 December 2014 and 13 March 2015 and acted as director of All Stars from at least 30 August 2016. ? All Stars took over the business of a connected company which traded as a fast-food takeaway from premises at the same address. He was the sole appointed director of that company. ? Businesses are required to register for VAT when their sales exceed the VAT threshold. ? HMRC made unannounced visits to establish All Stars’ cash takings on 30 August, 2016, 14 September 2016 and 28 April 2017. ? On 1 January 2017 All Stars was registered for VAT. ? No VAT returns were ever submitted to HMRC and an assessment of £599 was raised for quarter 02/17 on 13 April 2017, which was paid in full. The assessment of £16,100 raised for the following quarter (05/17) remained outstanding at liquidation. ? On 16 June 2017, HM Revenue & Customs (“HMRC”) notified All Stars that it was considered that the effective date of VAT registration was 4 December 2014 and that assessed VAT due for the period 4 December 2014 to 11 January 2017 amounted to £127,747. ? Further assessments totalling £49,006 were levied for quarters 05/15 to 02/18 ? As a result of All Stars’ late registration for VAT, HMRC imposed penalties of £111,779 ? The only payment made by All Stars in respect of VAT was £599 on 1 August 2017. ? HMRC have claimed £287,932 VAT out of a deficiency of £328,478.
