A deficiency as regards creditors of £152,077.14 ? And share capital of £1 ? Making a total deficiency of £152,078.14 MATTERS OF UNFITNESS He caused Sango Air Conditioning and Heating Limited to trade to the detriment of Her Majesty’s Revenue and Customs (“HMRC”) between 14 September 2015, at the latest, and the company’s liquidation on 29 September 2017 in respect of Value Added Tax (“VAT”) and Pay As You Earn/Construction Industry Scheme tax (“PAYE/CIS”) deductions from employees and subcontractors. In that: VAT ? Returns were submitted in respect of periods from 01/15 to 07/17, showing a total liability of £72,645.39. As these returns were submitted late and the company already had VAT arrears, HMRC applied surcharges of £10,896.75. ? Between 14 September 2015 and the date of Liquidation, payments of £14,597.43 were made. Of this, £590.17 was applied to the 01/16 surcharge and the balance was applied to arrears for earlier periods. ? At the date of Liquidation, the company owed HMRC £94,858.82 in respect of VAT including additional charges and arrears from periods prior to 01/15. PAYE/CIS ? Total Liabilities of £30,572.86 were reported in respect of PAYE and CIS deductions from staff and subcontractors for the 2014/2015, 2015/2016, 2016/2017 and 2017/2018 financial years. ? No payments were made towards this liability, which was outstanding at the date of Liquidation. Comparative Treatment ? Between 14 September 2015 and liquidation £389,868 was received into the company’s bank account. ? Of this, none was paid to HMRC in respect of PAYE/CIS. In the same period, the PAYE/CIS liability increased by £16,922. ? £14,597 was paid to HMRC in respect of VAT. In the same period, the VAT liability increased by £61,381. ? In total, £22,045 was paid to HMRC, including a payment of £7,448 made in respect of Corporation Tax in May 2016. Page 4 of 4 ? The company had one trade creditor at liquidation. Between 14 September 2015 and liquidation this creditor was paid £39,913 and had an outstanding liability of £7,797 at liquidation, with the last payment being made to them three weeks prior. In total, after 14 September 2015 £166,558 was paid to trade creditors, £31,923 was withdrawn in cash, £22,045 was paid to HMRC, £77,526 was paid to staff and subcontractors, and the balance of £91,316 was expended on other trade expenses and personal expenditure by the director.
