Making a total deficiency of £67,750 MATTERS OF UNFITNESS He failed to ensure that Rather Good Productions Limited (“RGP”) dealt properly with its tax affairs and caused it to trade to the detriment of HM Revenue & Customs (“HMRC”) from at least 07 July 2014 when Value Added Tax (“VAT”) for the quarter to May 2014 fell due, to its cessation in January 2017 (‘the period’). A total of £42,070 (including surcharges) became due to HMRC during the period and remained outstanding at the date of liquidation. In that: VAT ? VAT returns for the quarters May 2014 to May 2016 inclusive and VAT assessments for the quarters August 2016 to November 2016 recorded liabilities totalling £38,104, against which payments of £479 were made, leaving outstanding liabilities of £37,625. ? The last payment made towards VAT was on 16 November 2015, which part paid the amount due for May 2014, however a balance remained outstanding; ? At the liquidation date, a total of £42,070 was due for VAT for the period but not paid over, including surcharges of £4,445. Comparative treatment ? HMRC are the majority creditor in the liquidation, owed £55,748 (including Pay As You Earn/National Insurance Contribution (“PAYE/NIC”), Corporation Tax and interest). The Statement of Affairs shows 2 trade and expense creditors owed £12,000. ? RGP used 4 bank accounts. Statements are available for 2 of the accounts from February 2015 and from March and June 2016 for the other 2. ? Total payments made from 01 April 2015 were at least £122,005, of which £497 is recorded as being paid to HMRC (allocated to PAYE/NIC for 2013/14).
